General information on the legal basis for data processing on this website

If you have consented to data processing, we will process your personal data on the basis of Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR if special categories of data are processed pursuant to Art. 9 (1) GDPR (the latter may be the case, for example, in the context of an application). In the event of express consent to the transfer of personal data to third countries, data processing will also be carried out on the basis of Art. 49 (1) (a) GDPR. If you have consented to the storage of cookies or to access information on your device (e.g. via device fingerprinting), data processing will also be carried out on the basis of Section 25 (1) TDDDG. Your consent can be revoked at any time. If your data is required to fulfill the contract or to carry out pre-contractual measures, we will process your data on the basis of Art. 6 (1) (b) GDPR, provided that you, as a natural person, are our direct contractual partner. If we process your data as an employee of our contractual partner, this is done on the basis of our legitimate interest pursuant to Art. 6 (1) (f) GDPR, which is based on the smooth and transparent processing of our collaboration. Furthermore, we process your data, if necessary to fulfill a legal obligation, on the basis of Art. 6 (1) (c) GDPR. Data processing may also be based on our legitimate interest pursuant to Art. 6 (1) (f) GDPR. The relevant legal bases in each individual case are explained in the following paragraphs of this privacy policy.

Recipients of personal data

As part of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary to fulfill a contract, if we are legally obliged to do so (e.g., passing on data to tax authorities), if we have a legitimate interest in the transfer pursuant to Art. 6 (1) (f) GDPR, or if another legal basis permits the data transfer. When using contract processors, we only pass on our customers' personal data on the basis of a valid contract for order processing. In the case of joint processing, a contract for joint processing is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke your consent at any time. The legality of the data processing carried out up to the time of revocation remains unaffected.

Right to object to data collection in special cases and to direct marketing (Article 21 GDPR)

If data processing is based on Art. 6 (1) (e) or (f) GDPR, you have the right to object at any time to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this data protection information. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims (objection pursuant to Art. 21 (1) GDPR). If your personal data is processed in order to conduct direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to the examinee insofar as it is associated with such direct advertising. If you object, your personal data will subsequently no longer be used for direct marketing purposes (objection according to Art. 21 Para. 2 GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or place of the alleged violation. This right of complaint is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if technically feasible.

Information, correction and deletion

Within the scope of applicable law, you have the right at any time to obtain free information about your stored personal data, its origin and recipient, and the purpose of data processing, as well as the right to have this data corrected or deleted. You can contact us at any time with any questions about this or other issues relating to personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. You have the right to request that the processing of your personal data be restricted while we verify your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you require it to exercise, defend or assert legal claims, you have the right to request that the processing of your personal data be restricted instead of deleted.
  • If you have lodged an objection pursuant to Art. 21 (1) GDPR, your interests must be weighed against ours. As long as it is not yet clear whose interests prevail, you have the right to request that the processing of your personal data be restricted.

If you have restricted the processing of your personal data, this data may – with the exception of its storage – only be processed with your consent or for the establishment, exercise or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

4. Data collection on this website

Cookies

Our website uses so-called "cookies." Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after your visit. Persistent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain third-party services within websites (e.g., cookies for processing payment services).

Cookies serve various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or displaying videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are required to carry out electronic communication, to provide certain functions you have requested (e.g. for the shopping cart function) or to optimize the website (e.g. cookies to measure web audience) (necessary cookies) are stored on the basis of Art. 6 (1) (f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and similar recognition technologies has been requested, processing will take place exclusively on the basis of this consent (Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG); this consent can be revoked at any time.

You can configure your browser to inform you about the use of cookies and to only accept cookies on a case-by-case basis, to exclude cookies for specific cases or in general, and to automatically delete cookies when closing your browser. Disabling cookies may limit the functionality of this website.

You can find out which cookies and services are used on this website in our Cookie Information.

Consent with Cookiebot

Our website uses Cookiebot's consent technology to obtain your consent to the storage of certain cookies on your device or to the use of certain technologies and to document this consent in compliance with data protection regulations. The provider of this technology is Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark (hereinafter "Cookiebot").

When you visit our website, a connection is established to Cookiebot's servers to obtain your consent and other declarations regarding cookie use. Cookiebot then stores a cookie in your browser to assign the consent you have given or revoked to you. The data collected in this way is stored until you request its deletion, delete the Cookiebot cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention periods remain unaffected.

Cookiebot is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6 (1) (c) GDPR.

Server log files

The website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes:

  • Browser type and version
  • operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP Address

This data will not be merged with other data sources.

This data is collected on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be collected.

Contact form

If you send us inquiries via the contact form, your information from the form, including the contact details you provided there, will be stored by us for the purpose of processing your inquiry and in case of follow-up questions. We will not share this data without your consent.

This data is processed on the basis of Art. 6 (1) (b) GDPR, provided your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures, and provided you, as a natural person (optician), are our direct contractual partner. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR), if requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request its deletion, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular, retention periods—remain unaffected.

Inquiry by email, telephone or fax

If you contact us by email, phone, or fax, your inquiry, including all personal data (name, inquiry), will be stored and processed by us for the purpose of processing your request.

The data you send us via contact requests will remain with us until you request its deletion, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular, statutory retention periods—remain unaffected.

5. Plugins and tools

Friendly Captcha

We use Friendly Captcha (hereinafter "Friendly Captcha") on this website. The provider is Friendly Captcha GmbH, Am Anger 3-5, 82237 Woerthsee, Germany.

Friendly Captcha is designed to verify whether data entry on this website (e.g., in a contact form) is being carried out by a human or an automated program. To do this, Friendly Captcha analyzes the behavior of the website visitor based on various characteristics. For the analysis, Friendly Captcha evaluates various information (e.g., anonymized IP address, referrer, time of visit, etc.). Further information can be found at: https://friendlycaptcha.com/legal/privacy-end-users/.

The data is stored and analyzed on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in protecting its website from abusive automated spying and spam. If consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user's device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

6. Analysetools

Use and application of wipe analytics (only with your consent)

The controller has integrated components of the company Wipe Analytics on this website. Wipe Analytics is a web analysis service. Web analysis is the collection, gathering, and evaluation of data on the behavior of website visitors. A web analysis service collects, among other things, data about the website from which a data subject came to a website (so-called referrers), which subpages of the website were accessed, or how often and for how long a subpage was viewed. Web analysis is primarily used to optimize a website and for the cost-benefit analysis of online advertising. The operating company of Wipe Analytics is TENSQUARE GmbH, Wilhelminenstr. 29, 45881 Gelsenkirchen, Germany.

Wipe Analytics sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. With each call-up to one of the individual pages of this website, which is operated by the controller and on which a Wipe Analytics component was integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Wipe Analytics component to transmit data for marketing and optimization purposes to Wipe Analytics. As part of this technical procedure, Wipe Analytics receives data that is subsequently used to create pseudonymous user profiles. The user profiles obtained in this way are used to analyze the behavior of the data subject who has accessed the website of the controller and are evaluated with the aim of improving and optimizing the website.

The data collected via the Wipe Analytics component will not be used to identify the data subject without prior, separate and explicit consent from the data subject. This data will not be merged with personal data or with other data containing the same pseudonym.

The data subject can, as already explained above, prevent the setting of cookies through our website at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Wipe Analytics from placing a cookie on the information technology system of the data subject. In addition, cookies already set by Wipe Analytics can be deleted at any time via the Internet browser or other software programs. Furthermore, the data subject has the option of objecting to and preventing the collection of data generated by the Wipe Analytics cookie relating to the use of this website as well as the processing of this data by Wipe Analytics. To do so, the data subject must click the cookie button under the link https://www.wipe-analytics.de/opt-out, which sets an opt-out cookie. The opt-out cookie set with the objection is stored on the information technology system used by the data subject. If the cookies are deleted from the data subject's system after an objection, the data subject must access the link again and set a new opt-out cookie. However, setting the opt-out cookie may prevent the data subject from fully using the controller's website. Wipe Analytics' applicable privacy policy can be found at https://www.wipe-analytics.de/privacy.

7. Optician Login (our B2B portal exclusively for opticians)

Processing of customer and contract data

Our portal is available exclusively to opticians. You can register online. Your data will then be reviewed by us. Once the review is successful, you will receive the relevant contract documents with further data protection information.

We collect, process, and use personal customer and contract data to establish, define, and modify our contractual relationships. We collect, process, and use personal data about the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill them.

The collected customer data will be deleted after completion of the order or termination of the business relationship and expiration of any applicable statutory retention periods. Statutory retention periods remain unaffected.

Data transfer upon conclusion of contract for online shops, retailers and shipping of goods

When you order goods from us, we pass your personal data on to the transport company entrusted with delivery and to the payment service provider commissioned with processing the payment. Only the data required by the respective service provider to fulfill their task will be released. This data is processed on the basis of Art. 6 (1) (b) GDPR if your request is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR), if this consent was requested; this consent can be revoked at any time.

8. Applications

Handling applicant data

We offer you the opportunity to apply to us (e.g., by email, post, or via the online application form on our careers page). Below, we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data will be carried out in compliance with applicable data protection laws and all other legal provisions, and that your data will be treated with strict confidentiality.

Scope and purpose of data collection

If you send us an application, we will process your associated personal data (e.g., contact and communication details, application documents, notes taken during job interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the Federal Data Protection Act (BDSG) under German law (initiation of an employment relationship), Art. 6 (1) (b) GDPR (general contract initiation), and – if you have given your consent – Art. 6 (1) (a) GDPR. This consent can be revoked at any time. Within our company, your personal data will only be passed on to people who are involved in processing your application.

If your application is successful, the data you submit will be stored in our data processing systems on the basis of Section 26 BDSG and Article 6 (1) (b) GDPR for the purpose of implementing the employment relationship.

Data retention period

If we are unable to make you a job offer, if you reject a job offer, or if you withdraw your application, we reserve the right to retain the data you have submitted for up to six months from the end of the application process (rejection or withdrawal of the application) based on our legitimate interests (Art. 6 (1) (f) GDPR). The data will then be deleted and the physical application documents destroyed. Retention is primarily for evidential purposes in the event of a legal dispute. If it is apparent that the data will be required after the six-month period (e.g., due to impending or pending legal proceedings), deletion will only occur when the purpose for further retention no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 (1) (a) GDPR) or if statutory retention periods prevent deletion.
